The State of Michigan has been below the CDC threshold for the definition of an epidemic since June 1st. This fact has not stopped Director of MI Health and Human Services, Robert Gordon, from issuing emergency orders under the epidemic section of the Michigan Public Health Code.
It is unclear what measure the Director is using as the basis of his emergency orders. The legislature and media have not yet pressed the Director for his reasoning and scientific justification.
Meanwhile, these provisions of the Public Health Code are being used to reinstate many of the same orders issued by Governor Whitmer under the 1945 statute which had been declared unconstitutional by the Michigan Supreme Court.
